ART. 155
Mayor's Responsibilities
(1) The mayor performs the following main categories of responsibilities:
a) responsibilities exercised as a representative of the state, under the law;
b) responsibilities regarding the relationship with the local council;
c) responsibilities regarding the local budget of the administrative-territorial unit;
d) responsibilities regarding public services provided to citizens, of local interest;
e) other responsibilities established by law.
(2) Based on paragraph (1) letter a), the mayor:
a) performs the function of civil status officer and guardian and ensures the functioning of local public services of this profile;
b) performs responsibilities regarding the organization and conduct of elections, referendums, and censuses;
c) performs other responsibilities established by law.
(3) In exercising the responsibilities provided in paragraph (1) letter b), the mayor:
a) presents to the local council, in the first quarter of the year, an annual report on the economic, social, and environmental status of the administrative-territorial unit, which is published on the website of the administrative-territorial unit, under the conditions provided by law;
b) participates in the meetings of the local council and takes the necessary measures for their proper preparation and conduct;
c) presents, at the request of the local council, other reports and information;
d) develops, following public consultations, draft strategies regarding the economic, social, and environmental status of the administrative-territorial unit, publishes them on the website of the administrative-territorial unit, and submits them for approval to the local council.
(4) In exercising the responsibilities provided in paragraph (1) letter c), the mayor:
a) exercises the function of the main credit authorizer;
b) prepares the draft budget of the administrative-territorial unit and the closing account of the budgetary exercise and submits them for approval to the local council, under the conditions and deadlines provided by law;
c) presents periodic reports to the local council regarding budget execution, under the conditions provided by law;
d) initiates, under the conditions provided by law, negotiations for contracting loans and issuing securities on behalf of the administrative-territorial unit;
e) verifies, through specialized departments, the correct fiscal registration of taxpayers at the territorial fiscal authority, both for the main headquarters and the secondary headquarters.
(5) In exercising the responsibilities provided in paragraph (1) letter d), the mayor:
a) coordinates the provision of local public services of interest through the specialized apparatus or through the bodies providing local public services and public utilities of local interest;
b) takes measures to prevent and, if necessary, manage emergency situations;
c) takes measures to organize and concretely carry out the activities in the fields provided in Article 129 paragraph (6) and (7);
d) takes measures to ensure the inventory, statistical records, inspection, and control of the provision of local public services provided in Article 129 paragraph (6) and (7), as well as the assets of the public and private property of the administrative-territorial unit;
e) appoints, sanctions, and suspends, modifies, and terminates employment relationships or, where applicable, labor relationships, under the conditions provided by law, for the personnel within the specialized apparatus, as well as for the heads of local public institutions and services;
f) ensures the development of urban planning plans provided by law, submits them for approval to the local council, and takes action to comply with their provisions;
g) issues opinions, agreements, and authorizations within its competence by law and other normative acts, after verification and certification by the specialized departments, regarding regularity, legality, and compliance with technical requirements;
h) ensures the completion of works and takes the necessary measures to comply with the commitments assumed in the process of European integration in the field of environmental protection and water management for the services provided to citizens.
(6) The mayor designates specifically authorized civil servants to fulfill the obligations regarding the communication of citations and other procedural acts, under the conditions of Law no. 135/2010, with subsequent amendments and completions.
(7) For the proper exercise of its responsibilities, the mayor collaborates with the decentralized public services of the ministries and other specialized bodies of central public administration in the administrative-territorial units, as well as with the authorities of local and county public administration.
(8) The appointment of the heads of local public institutions, respectively of the heads of local public services, is made based on the competition or examination organized according to the procedures and criteria approved by the local council, at the proposal of the mayor, under the conditions of Part VI Title II Chapter VI or Title III Chapter IV, as applicable.
ART. 156
Mayor's Responsibilities as a Representative of the State
(1) In exercising the responsibilities of a guardian and civil status officer, the tasks provided by the normative acts regarding the census, the organization and conduct of elections, the measures for civil protection, as well as other responsibilities established by law, the mayor acts as a representative of the state in the commune, city, or municipality where he/she was elected.
(2) In this capacity, the mayor may request the support of the heads of decentralized public services of the ministries and other specialized bodies of central public administration in the administrative-territorial units, under the conditions provided by law, if the tasks assigned to him/her cannot be solved through the specialized apparatus.
ART. 157
Delegation of Responsibilities
(1) The mayor may delegate, by order, the responsibilities conferred by law and other normative acts to the deputy mayor, the general secretary of the administrative-territorial unit/subdivision, the heads of functional departments, or the personnel within the specialized apparatus, the public administrator, as well as the heads of local public institutions and services, according to their competencies in the respective fields.
(2) The delegation order must specify the period, the delegated responsibilities, and the limits of exercising the delegated responsibilities, under the penalty of nullity. The delegation order cannot include all the responsibilities provided by law for the mayor. Delegation of responsibilities is only done with prior notification of the person to whom the responsibilities are delegated.
(3) The person to whom responsibilities have been delegated under paragraphs (1) and (2) exercises, during the delegation period, the responsibilities of the position they hold, as well as the delegated responsibilities; sub-delegation of responsibilities is prohibited.
(4) The person to whom responsibilities have been delegated under paragraphs (1) and (2) is civilly, administratively, or criminally liable, as the case may be, for acts committed in violation of the law in exercising these responsibilities.
